1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and PotteryKing ("we," "us" or "our"), concerning your access to and use of our website, services, and studio facilities.

By accessing or using the PotteryKing services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the services.

2. Intellectual Property Rights

Unless otherwise indicated, the website and all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by PotteryKing, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Regarding physical artwork:

  • You retain ownership of physical pottery and other items you create during classes or open studio time.
  • PotteryKing reserves the right to photograph your work created in our studio and use these photographs for promotional purposes, unless you specifically opt out in writing.
  • Instructional materials, techniques, and recipes provided in classes are proprietary to PotteryKing and are for your personal use only.

3. User Representations

By using the PotteryKing services, you represent and warrant that:

  1. You have the legal capacity and agree to comply with these Terms of Service;
  2. You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use our services;
  3. You will not access the services through automated or non-human means;
  4. You will not use the services for any illegal or unauthorized purpose;
  5. Your use of the services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the services.

4. Membership and Purchases

Membership Terms: PotteryKing offers various membership options with different benefits and pricing. Specific terms for each membership level are outlined on our website and will be provided at the time of purchase.

Billing: Memberships are billed on a recurring basis (monthly, quarterly, or annually, depending on your selection). By signing up for a membership, you authorize us to charge your payment method on an ongoing basis until you cancel.

Membership Changes: You may upgrade, downgrade, or cancel your membership at any time by contacting us or through your account settings. Changes to membership level will take effect at the start of the next billing cycle.

Class and Workshop Purchases: When you register for a class or workshop, you are securing a spot that may be limited in availability. Payments for classes and workshops are due in full at the time of registration.

5. Refund Policy

Memberships: Memberships are non-refundable for the current billing period. When you cancel a membership, you will continue to have access until the end of your current billing period.

Classes and Workshops: Refunds for classes and workshops are available under the following conditions:

  • Full refund (minus a 10% processing fee) if canceled 7 or more days before the class start date
  • Studio credit only if canceled within 7 days of the class start date
  • No refund or credit for no-shows or cancellations after the class has started

Exceptions: Full refunds will be provided if PotteryKing cancels a class or workshop. In extraordinary circumstances (medical emergencies, etc.), exceptions may be considered at our discretion.

6. Prohibited Activities

You may not access or use the services for any purpose other than that for which we make them available. The services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the services, you agree not to:

  • Systematically retrieve data or other content from the services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us;
  • Use the services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use;
  • Use any robot, spider, or other automatic device, process, or means to access the services for any purpose;
  • Use the services in any way that violates any applicable federal, state, local, or international law or regulation;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the services;
  • Harass, abuse, or harm another person during use of our facilities or services;
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the services or any server, computer, or database connected to the services.

7. Studio Safety and Rules

Safety is of paramount importance at PotteryKing. By using our studio facilities, you agree to:

  • Follow all safety instructions provided by staff members;
  • Wear appropriate clothing and footwear (closed-toe shoes required in the pottery studio);
  • Use safety equipment as instructed (eye protection, gloves, etc.);
  • Report any unsafe conditions, accidents, or injuries immediately;
  • Never operate equipment you have not been trained to use;
  • Not enter the studio under the influence of alcohol or drugs;
  • Clean up after yourself and maintain a tidy workspace;
  • Respect the work and space of other members and students;
  • Not bring outside materials (especially glazes or chemicals) without prior approval;
  • Follow all posted studio rules and guidelines.

Violation of safety rules may result in being asked to leave the studio and, in serious cases, termination of membership without refund.

8. User Contributions

The services may contain message boards, forums, bulletin boards, social media interaction, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials.

Any user contribution you post to the site will be considered non-confidential and non-proprietary. By providing any user contribution on the services, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

You represent and warrant that all of your user contributions comply with these Terms of Service, and you understand and acknowledge that you are responsible for any user contributions you submit or contribute.

9. Limitation of Liability

In no event will PotteryKing, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the services, including any direct, indirect, special, incidental, consequential, or punitive damages.

By participating in pottery-making, cooking classes, and other activities at our facility, you acknowledge that these activities involve inherent risks. You agree to assume all risk of personal injury, illness, death, or property damage associated with participation in our activities.

10. Indemnification

You agree to defend, indemnify, and hold harmless PotteryKing, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the services.

11. Term and Termination

These Terms of Service shall remain in full force and effect while you use the services.

We may terminate or suspend your access to the services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

We reserve the right to refuse service to anyone for any reason at any time.

12. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the services without notice at any time.

We cannot guarantee the services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the services at any time or for any reason without notice to you.

13. Governing Law

These Terms of Service and your use of the services are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.

14. Dispute Resolution

Any legal action or proceeding arising out of these Terms of Service or the services shall be exclusively brought in the federal or state courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction of such courts.

The parties agree that any dispute between them arising out of or relating to these Terms of Service or the services shall first be submitted to mediation in Los Angeles County, California, in accordance with the mediation rules of the American Arbitration Association then in effect.
